These Terms of Service ("Terms") are a legal agreement between you ("you", "your", or "Customer") and Wabi Pty Ltd (ABN pending), an Australian company ("Wabi", "we", "us", or "our"). By creating an account or using any part of the Wabi platform, you agree to these Terms. If you don't agree, don't use Wabi.
If you're accepting these Terms on behalf of a business, you represent that you have the authority to bind that business.
Wabi is a modular software-as-a-service (SaaS) platform designed for businesses that serve customers — restaurants, salons, gyms, clinics, retail stores, hotels, and more. You choose the modules you need:
We may add, modify, or retire modules over time. We'll give you reasonable notice of material changes.
To use Wabi, you need to create an account. You agree to:
You must be at least 18 years old and legally able to enter into contracts in your jurisdiction.
We offer a 14-day free trial. No credit card required. During the trial you get full access to the platform so you can evaluate whether Wabi is right for your business.
At the end of 14 days, you'll need to choose a paid plan to continue using Wabi. If you don't, your account will be suspended (not deleted — see Section 11 on data retention).
We reserve the right to modify or discontinue the free trial at any time.
You only pay for the modules you use. Pricing is published on our website and may change with 30 days' notice.
All subscriptions are month-to-month. There are no long-term commitments.
You can add or remove modules at any time. Changes take effect immediately. Charges are prorated — you'll receive credit for unused time on removed modules and be charged proportionally for new ones.
Subscription payments are processed securely. Transaction processing through Wabi POS is handled by Stripe at a rate of 2.6% + $0.10 per transaction. Stripe's terms apply to payment processing.
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We don't offer refunds for partial months, but you'll retain access until the period ends.

We may suspend or terminate accounts that violate these terms.
This is simple: your data belongs to you. Always.
All business data, customer records, transaction history, staff information, and any other data you input into Wabi remains your property. We do not claim ownership of your data.
You grant us a limited licence to process your data solely to provide and improve the Wabi service. This licence ends when you delete your data or close your account.
You can export your data at any time. If you close your account, we'll make your data available for export for 30 days before permanent deletion (see our Privacy Policy for details).
Wabi Intelligence uses large language models to analyse your business data and surface insights — trends, patterns, and recommendations.
Important things to know:
Wabi and its components — the software, design, branding, documentation, and all related intellectual property — belong to Wabi Pty Ltd. These Terms don't transfer any ownership to you.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the platform for your internal business purposes during your active subscription.
To the maximum extent permitted by law:
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including the Australian Consumer Law.
You can close your account at any time. Your subscription continues until the end of the current billing period.
We may suspend or terminate your account if you breach these Terms, fail to pay, or if we're required to do so by law. We'll provide reasonable notice where possible.
Upon termination, your right to use the platform ends. We'll retain your data for 30 days to allow export, after which it will be permanently deleted. Provisions that should survive termination (liability, IP, disputes) will survive.
These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria.
Before taking legal action, you agree to try to resolve any dispute by contacting us at legal@wabify.com. We'll work in good faith to resolve things within 30 days.
We may update these Terms from time to time. When we make material changes, we'll give you at least 30 days' notice via email or an in-app notification before the changes take effect.
Continued use of Wabi after changes take effect constitutes acceptance. If you disagree with the changes, you may close your account.
